Attorney Muwonge's practice is dedicated to Accident & Personal Injury work and his most notable case is Antwaun A vs. Heritage, a Wisconsin Supreme Court case involving a child who suffered from lead poisoning due to the ingestion of paint chips while visiting the apartment leased by his mother and while visiting the apartment leased by his aunt. The defendants admitted to constructive or actual notice about the peeling or chipping paint within the apartments, but argued they did not have any actual or constructive knowledge of the presence of lead on their properties.
Because they did not have any notice of lead-based paint, they had no duty to the plaintiff to inspect for the lead. The trial court agreed and dismissed the claim of negligence. Muwone appealed, and the Supreme Court agreed to address the following question:
Does a landlord of an older residential rental property have a common law duty to inspect or test for contamination from lead-based paint once the landlord knows that the paint is flaking from the walls constructed prior to 1978? The Supreme Court agreed with Muwonge and the case settled soon after for a confidential amount.
